Terms of Use

1. About Finturu

Finturu is a marketplace platform that allows vendors to sell products globally in USD and receive payouts in their local currency. By using our platform, you agree to these terms.


2. Who Can Use Finturu

  • You must be at least 18 years old
  • You must have the legal right to enter into agreements
  • You must provide accurate information when creating your account
  • You must comply with all applicable laws in your jurisdiction


3. Vendor Responsibilities

Product Listings

  • You own or have permission to sell all products you list
  • Product descriptions must be accurate and not misleading
  • You’re responsible for product quality and customer satisfaction
  • You must honor all sales and provide products as described

Legal Compliance

  • You must comply with all applicable laws and regulations
  • You’re responsible for any required licenses or permits
  • You must handle taxes and legal obligations in your jurisdiction
  • You cannot sell prohibited or illegal items

Customer Service

  • You must respond to customer inquiries promptly
  • You’re responsible for handling returns and refunds according to your policies
  • You must resolve disputes professionally


4. Finturu’s Role

Platform Services

  • We provide the marketplace platform and payment processing
  • We facilitate transactions between you and customers
  • We handle currency conversion from USD to your local currency
  • We provide customer support and technical assistance

What We Don’t Do

  • We don’t own, store, or ship your products
  • We’re not responsible for product quality or disputes
  • We don’t guarantee sales or income levels
  • We’re not liable for tax or legal compliance issues


5. Fees and Payments

Commission

  • Finturu charges 4% commission on each successful sale
  • Commission is automatically deducted from your earnings
  • No other fees apply (no listing, monthly, or setup fees)

Payouts

  • You sell in USD but receive payouts in Colombian Pesos (COP)
  • Withdrawals are available on demand with a $50 USD minimum
  • Bank transfers are free and take 1-3 business days
  • We’ll expand to support additional currencies in the future

Refunds

  • If a customer receives a refund, the commission is also refunded to you
  • You’re responsible for any costs related to returns or refunds


6. Account Management

Your Account

  • Keep your login information secure
  • Update your information when it changes
  • You’re responsible for all activity on your account
  • We may suspend accounts that violate these terms

Termination

  • Either party can terminate this agreement at any time
  • Upon termination, you’ll receive any pending payments
  • Your obligations for completed sales continue after termination


7. Prohibited Activities

You cannot:

  • Sell illegal, dangerous, or prohibited items
  • Misrepresent products or use false information
  • Violate intellectual property rights
  • Engage in fraudulent activities
  • Manipulate reviews or ratings
  • Use the platform for money laundering or illegal financial activities


8. Intellectual Property

  • You retain ownership of your product content and images
  • You grant Finturu permission to display your content on the platform
  • Finturu owns the platform technology and branding
  • Respect others’ intellectual property rights


9. Privacy and Data

  • We collect and use information as described in our Privacy Policy
  • You consent to data processing necessary for platform operations
  • We may share information as required by law or to prevent fraud
  • You’re responsible for protecting your customers’ data


10. Limitation of Liability

  • Finturu provides the platform “as is” without warranties
  • We’re not liable for lost profits, data, or indirect damages
  • Our liability is limited to the fees paid to us in the past 12 months
  • You indemnify Finturu against claims related to your products or actions


11. Dispute Resolution

Between Vendors and Customers

  • You’re primarily responsible for resolving customer disputes
  • Finturu may assist with dispute resolution at our discretion
  • Customers may file chargebacks through their payment providers

Between You and Finturu

  • We’ll first try to resolve disputes through direct communication
  • Disputes will be governed by Colombian law
  • Legal proceedings must be filed in Bogotá, Colombia


12. Changes to Terms

  • We may update these terms occasionally
  • We’ll notify you of significant changes via email or platform notification
  • Continued use of the platform means you accept the updated terms
  • If you don’t agree to changes, you may terminate your account


13. Amazon Integration

  • Amazon synchronization is an optional feature
  • You’re responsible for complying with Amazon’s terms and policies
  • Finturu isn’t responsible for Amazon-related issues or suspensions
  • Amazon sales are subject to Amazon’s fees in addition to Finturu’s commission


14. General Provisions

Entire Agreement These terms, along with our Privacy Policy, constitute the complete agreement between you and Finturu.

Severability If any part of these terms is found invalid, the rest remains in effect.

Force Majeure Neither party is liable for delays or failures due to circumstances beyond reasonable control.

Assignment You cannot transfer your rights under this agreement without our permission.

By creating an account and using Finturu, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
